§ 42-41. Dead or diseased trees.

  • All dead trees and trees afflicted with any fatal or communicable disease located on either public or private property shall be removed and destroyed by the superintendent of public works upon the approval of the village council. The cost of such removal and destruction may be paid, in whole or in part, by levying and collecting special amounts upon the owners of the property from which the trees are removed. The village council may remove living trees located on public rights-of-way after giving abutting property owners 30 days' prior written notice of intent to remove the trees. In the event of an objection from the abutting property owners, the trees shall not be removed until after a public hearing has been held by the village council to consider the removal. Living trees may also be removed from public rights-of-way when the owner of the property in front of which such trees are situated shall, in writing, request the removal of such trees.
