§ 42-42. Landowners petitioning village for planting or removal.

  • Persons owning a majority of the lineal footage of the property fronting on the line of any street in the immediate blocks in which planting of new trees or removal of existing trees is desired, may petition the village council to plant or remove trees or shrubs along such street. Where an owner of property requests or has petitioned for the removal of trees, the superintendent of public works is authorized at his discretion to require as a condition precedent to granting approval for such removal that such property owner make the removal in accordance with regulations established by the village council, to assume all or any part of the cost of removing such trees, and also to further require that such trees be replaced at some other location in the immediate vicinity by planting other trees of a type permitted under this article.
